We offer mediation services for all causes of action brought in Florida Circuit Civil and County Courts.

Federal Court Mediation

We offer mediation services for all causes of action brought in any U.S. District Court. Mr. Silber is admitted in over 20 across the country and has experience as a federal court litigator.

Probate Mediation

We offer mediation services for all causes of action brought in Florida's probate courts including disputes about real property, financial assets, and keepsakes.

Arbitration Services

We offer arbitration services for all causes of action brought in Florida's Circuit Civil, County, and Probate Courts as well as any cause of action brought in U.S. District Courts.

Get To Know Brian Silber

 

Brian Silber is a career litigator and trial attorney with 20+ years of courtroom experience. He has tried over 65 jury trials and more than 50 non-jury trials to verdict. His trial and litigation experience is in both state and federal courts. He is admitted to practice in Florida and over 20 U.S. District Courts across the country. 

Mr. Silber began his career in 2003 at the Broward State Attorney's Office where he served as a special unit prosecutor and supervisor for the Honorable Michael J. Satz. In 2006, he left government service and entered private practice where he practiced civil litigation in Florida and federal courts.

As a mediator and arbitrator, he leans heavily on his professional experience and knowledge of the law to formulate opinions and perspectives that are grounded in evidence, procedure, and the realities of litigation. Mr. Silber is driven to serve the parties with the best of his skill, professionalism, and neutrality.

Mr. Silber is a two-time graduate of the University of Miami where he earned his Juris Doctor in 2002 and a Bachelor of Business Administration with a major in finance in 1999. Mr. Silber attended business school on an academic scholarship. He is also an alumnus (Class of 1995) of the Scheck Hillel Community School in North Miami Beach, Florida where he studied as a dual-curriculum yeshiva track student.

Cancellations place an undue burden upon the mediator/arbitrator, especially short notice cancellations. Any mediation or arbitration that is cancelled or rescheduled more than five (5) days prior to the scheduled session will not incur any cancellation charge.

If a mediation or arbitration session is cancelled or rescheduled less than five (5) days prior to the scheduled session, the two (2) hour minimum or 50% of the scheduled time will be charged to the party or parties requesting the cancellation or rescheduling, whichever is greater.

Notices or cancellations submitted to the court are not an accepted form of notification of cancellation. Our office must be contacted directly to cancel or reschedule and it is the responsibility of all parties. Requests to cancel or reschedule must be sent to Lia Gale at [email protected].

Cancellation charges apply to settled cases. Please factor this in when settling a case within the cancellation period.

If you or your client require a translator or sign language interpreter please let us know when you schedule your session so we can make the appropriate arrangements in advance of your mediation/arbitration.

Mr. Silber's mediation practice focuses on cases brought in Florida. However, he offers his services wherever they are needed regardless of jurisdiction. Unlike an attorney, a mediator can practice anywhere. Since most services are available via Zoom, it generally does not make a difference where you are located or where your case is litigated. For in-person services, Mr. Silber assesses reasonable travel costs when travel outside of South Florida is required, such as for airfare and hotel accommodations. Mr. Silber is available for both Zoom and in-person mediations and arbitrations. That said, 95% of all mediations and arbitrations are conducted via Zoom. This became the industry standard when Covid-19 hit and it has not changed due to its tremendous convenience. However, if your case is unusually sensitive or requires an in-person proceeding because it is court ordered to be in person or for any other reason, Mr. Silber is happy to accommodate your needs.
