Circuit Civil & County Court Mediation

Brian Silber is certfied by the Florida Supreme Court to mediate cases in both Circuit Court and County Court. He leans on 20+ years of litigation experience and 100+ trials to verdict to mediate business disputes, breach of contract claims, tort claims, property damage claims, debt collection, real estate disputes, condo/HOA lawsuits, commercial landlord/tenant claims, construction claims, and a variety of other causes of action. Mr. Silber's approach is rooted in evidence and procedure, it is direct and to the point, practical, knowledgeable, and always fair and impartial.

Federal Court Mediation

Admitted in over 20 U.S. District Courts across the country, Mr. Silber is available to mediate or arbitrate any civil matter brought in any federal jurisdiction or by any federal agency. His experience in federal civil litigation and administrative disputes with federal agencies are assets he leans on to mediate claims brought in federal court. He is familiar with the Federal Rules of Civil Procedure, Federal Rules of Evidence, Daubert, and the differences between federal and state court litigation.

Divorce & Family Court Mediation

Divorce and family law disputes are rough on the parties, especially when children and finances are involved. Mr. Silber is sensitive to the issues faced by people in a family dispute. Coming to an agreement about custody, visitation, financial responsibilities, alimony, division of property, modifications and other disputes can be very emotional, triggering, and stressful. In Mr. Silber's mediations, everyone has an opportunity to be heard, a professional decorum is always maintained, and the issues are handled pragmatically with empathy and respect for all involved.

Arbitration Services

Special Magistrate Services

Pursuant to Florida Rule of Civil Procedure 1.490, a Circuit Court judge may appoint members of The Florida Bar as special magistrates for any particular service required by the court. Common services include resolution of discovery disputes, overseeing contentious depositions, and other miscellaneous matters. Mr. Silber is an experienced Special Magistrate who leans on 20+ years of litigation experience to help the courts resolve disputes in a time efficient, fair, and impartial manner.

Real Estate Commission Services

Pursuant to Fla. Stat. 64.061, when a judgment of real estate partition is made, three commissioners are sworn to make the partition and determine its feasibility. Commissioners are required to act faithfully, fairly, and impartially. They are empowered to hire surveyors and conduct site visits. Ultimately, a real estate commissioner is an independant third party brought in to ensure a fair partition and to determine if a partition is even possible. Mr. Silber offers his 20+ years of litigation experience, his knowledge of real estate, an open mind, and his practical approach to problem solving to render an objective and fair decision based on the facts and evidence.
